4. Newsletter

Our newsletter and other automatically sent e-mails in connection with a purchase are sent via MailChimp, a service of The Rocket Science Group LLC based in the USA. The use of MailChimp essentially ensures that the e-mails are sent reliably and are more likely not to end up in the spam filter. The adequate level of data protection for the processing of data by MailChimp is guaranteed by its Privacy Shield certification (list entry). We have also concluded a contract for data processing with MailChimp.

Privacy Shield certified

As a principle we do not pass on your data to third parties. But: there are exceptions to every principle. Since the operation of a larger e-mail newsletter is technically anything but trivial, we use a technical service provider where the processing and use of the data takes place. We have deliberately chosen MailChimp as operator of the newsletter service. The company offers excellent technical features, has very well secured IT systems and first-class support. The Rocket Science Group LLC, which operates MailChimp, is certified according to the requirements of the Privacy Shield. In this respect, the conditions for the processing of personal data by MailChimp, which is permitted under data protection law, are met. The legal basis for the processing of data in the USA is Art. 6 para. 1 lit. f) DSGVO: data processing based on a balancing of interests. With regard to MailChimp we are convinced that the technical and organizational measures taken by MailChimp achieve a high level of protection for your data.

Objection

Of course, every person concerned can object to the use of his personal data at any time. This can be done by cancelling our newsletter. This is possible by clicking on a link at the end of each e-mail.

Analysis of the usage behaviour

Like other service providers, MailChimp offers statistical evaluation possibilities of usage data etc. The evaluation possibilities are first of all group-related. For example, we can see to how many users an email was sent, whether emails were rejected and whether users have unsubscribed from the list after receiving an email. In addition, MailChimp can also be used to track the opening and clicking behavior of individual recipients. There are several reasons why we use this possibility:

  1. we are convinced that we have an information mission. We are very happy to do so and our newsletter is part of it. With several 1000 subscribers it is also a cost factor, especially since MailChimp charges its services with a small but not negligible contribution per contact. For example, if we have a number of 300 people who receive our newsletter but de facto never use it, we can save costs if we no longer write to these people. The tracking of opening and click rates allows us to automatically delete recipients who have not used our newsletter for a longer period of time (e.g. six months).
  2. we can offer better services by tracking the click behaviour. This allows us to see which articles are read by which customers and to provide this segment with further information on this topic. By tracking opening and click rates, we can better identify which content is interesting for recipients and which is not or less interesting. In this way, we write less on the topic and more for the readers.
  3. Finally, tracking of opening and click rates also serves to increase sales. Of course we also inform in the newsletter about products we sell. It is relevant for us whether or not parts of an e-mail have led to a purchase decision.

As a rule, we only look at the tracking data in the form of aggregated reports. So we do not look specifically at whether a user clicked on this or that link, but rather what percentage of subscribers opened the e-mail and which links they clicked on. The data of a particular person is usually only viewed individually if, for example, an error has occurred, a support request has been received or there was otherwise a concrete reason for it.

Other notes

If you open the respective e-mail for correct display in a browser via the link given in the e-mail, you will land on a web page of MailChimp. Among other things, the web analysis tool Google Analytics is used there. Unfortunately we cannot switch this off and have no access to the corresponding analyses. However, you can prevent tracking by Google Analytics and browser plugins with the usual measures.

Description of the processing of personal data

When you subscribe to the newsletter list, we only collect your e-mail address for a pure newsletter subscription. This way it is at least possible for you to use this service pseudonymously. In addition, we save the address of the Internet page on which the form you used to subscribe was located.

If you enter your e-mail address in the distribution list, this e-mail address is initially stored temporarily with the list provider (“MailChimp”). The e-mail address is stored only for the purpose of sending the owner of the e-mail address an e-mail in which the owner can confirm his or her membership of the e-mail list (“Double-Opt-In”). Once the e-mail address has been confirmed, it is stored permanently with the list provider until the e-mail address is deleted by the owner of the e-mail address or by us. In order to be able to prove the entry in the list and to be able to defend against any accusation of unsolicited e-mail, the list provider stores the date of the entry in the list as well as the IP address under which the entry was made. We have no influence on the fact that the IP address is stored, and we hereby expressly point out that the IP address is stored. Important: We do not use the IP address for any other purpose.

Furthermore, the following data is stored by MailChimp:

  • Date of the last profile update
  • Geolocation & time zone: Based on the e-mail address, MailChimp performs a geolocation and uses a “Geolocation Service Provider” to determine information about the IP address (geolocation data and possibly available location information). Geolocation is also used to determine time zones. This in turn is used for the simultaneous sending of newsletters at certain times, if required.
    Geolocation is carried out both when subscribing to the newsletter and when opening newsletter e-mails.
  • Language information: If MailChimp is able to determine the language you have set from your browser when subscribing to the newsletter or opening links, this will also be saved in your profile. This function can be used in particular to form segments of subscribers by language.
  • Groups & Segments: We sometimes send more than one newsletter, which is the same for all subscribers. Sometimes we send different newsletters that are different. For example, it may happen that newer subscribers may receive a different newsletter or a separate newsletter or e-mail.

Delete your data

Every newsletter e-mail contains a note on how you can have your e-mail address deleted. Alternatively you can contact us at any time. You can find our contact details in the disclosure or under contact. Of course, we are also available for other questions regarding the protection of your personal data and especially when exercising your rights as a person concerned.

Facebook

Our website includes links to the social network Facebook (Facebook Inc., 1 Hacker Way, Menlo Park, California 94025, USA). These are pure, conventional links. A connection between your browser and the Facebook server is only established when you click on such a link. Google AdWords and Google Conversion Tracking

As part of Google AdWords, we use so-called conversion tracking. When you click on an ad served by Google, a conversion tracking cookie is set.
